When you visit our website persistenceathletics.com, and use our services, you trust us with your personal information. We take your privacy very seriously. In this privacy policy, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy policy that you do not agree with, please discontinue use of our Sites and our services.

This privacy policy applies to all information collected through our website (such as persistenceathletics.com), and/or any related services, sales, marketing or events (we refer to them collectively in this privacy policy as the "Services").

Please read this privacy policy carefully as it will help you make informed decisions about sharing your personal information with us.

1) WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when registering at the Services expressing an interest in obtaining information about us or our products and services, when participating in activities on the Services or otherwise contacting us.

The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make and the products and features you use. The personal information we collect can include the following:

  • Publicly Available Personal Information. We collect first name, maiden name, last name, and nickname; phone numbers; email addresses; and other similar data.
  • Personal Information Provided by You. We collect purchase history; passwords; and other similar data.
  • Payment Data. We collect data necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument. All payment data is stored by Razorpay. You may find their privacy policy link(s) here: https://razorpay.com/privacy/.

All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

2) HOW DO WE USE YOUR INFORMATION?

In Short: We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

We use personal information collected via our Services for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

3) WILL YOUR INFORMATION BE SHARED WITH ANYONE?

In Short: We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations.

4) DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information. Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Policy.

5) HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information only as long as needed for the purpose it was collected, plus any period required by law (typically up to 7 years for payment and business records).

Retention by data type:

  • Account & profile (name, email, phone, login): kept for as long as your account is active. If you delete your account, we permanently remove it from our active systems within 30 days, except records we are legally required to retain (see below).
  • Class bookings & attendance history: kept for the life of your membership plus 12 months after cancellation, then anonymized.
  • Payment records (Stripe transactions, invoices, receipts): retained for 7 years to comply with US tax and accounting law (IRS). Card numbers are never stored by us; Stripe holds those.
  • Health / waiver forms: retained for 7 years after the last visit, per insurance and Washington State liability standards.
  • SMS consent records: retained for 4 years per TCPA guidance.
  • Marketing contacts (GoHighLevel CRM): retained until you unsubscribe, opt out via SMS STOP, or request deletion. If you have not engaged for 3 years, we automatically remove the record.
  • Website analytics (Google Analytics 4, Microsoft Clarity, Facebook Pixel): retained for 26 months from last activity; you can opt out via your browser, the GA opt-out add-on, or the Meta ad preferences page.
  • App data (iOS, future Android): the same retention periods above apply. Deleting the app from your device removes local cache; to delete your server-side data, see Section 7 below.

6) HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

All data is transmitted over HTTPS (TLS 1.2+). Server access is restricted to authorized staff and protected by SSH key authentication. Payment processing is delegated to Stripe (PCI-DSS Level 1 certified) so we never store card numbers ourselves. Member data is stored on managed cloud infrastructure (DigitalOcean) with automated backups, encrypted at rest. Despite our efforts, no method of transmission over the Internet is 100% secure.

7) WHAT ARE YOUR PRIVACY RIGHTS AND HOW DO YOU DELETE YOUR DATA?

In Short: You may review, update, or delete your account and personal information at any time. Most deletions complete within 30 days.

Right to access & correction: you can review and update your account info inside the member portal at app.persistenceathletics.com/portal or by emailing info@persistenceathletics.com.

Right to delete your account and data: you may request full deletion of your account and personal data at any time. We offer three options:

  • In-app: open the Persistence Athletics app, go to Profile → Settings → Delete account. The request is processed within 30 days.
  • In the member portal: sign in at app.persistenceathletics.com/portal and use the Delete my account link in the account settings page.
  • By email: send a request to info@persistenceathletics.com with the subject line "Delete my account". Include the email address associated with your account. We will confirm receipt within 2 business days and complete deletion within 30 days.

What gets deleted: your name, contact info, account login, marketing-CRM record, class booking history (after a 12-month grace period for dispute resolution), and any waiver / health intake forms past the 7-year legal retention window.

What we keep (legally required): Stripe payment records and invoices for 7 years (US tax law), signed liability waivers for 7 years after your last visit (Washington State liability standards), and any records subject to an active legal hold.

Right to opt out of marketing: reply STOP to any SMS, click Unsubscribe on any email, or email us. We process opt-outs within 24 hours.

8) DATA BREACH

A privacy breach occurs when there is unauthorized access to or collection, use, disclosure or disposal of personal information. You will be notified about data breaches when Persistence Athletics believes you are likely to be at risk or serious harm.

9) CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized.

10) DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

11) SMS COMMUNICATIONS

By providing your phone number to Persistence Athletics, you consent to receive text messages regarding bookings, class reminders, review requests, and gym updates. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time. Reply HELP for help. We will not share your phone number with third parties for marketing purposes. Carriers are not liable for delayed or undelivered messages.

12) DO WE MAKE UPDATES TO THIS POLICY?

In Short: Yes, we will update this policy as necessary to stay compliant with relevant laws.
